Regulations on Federal Forestry AgencyApproved by the Decision
(in wording of Decisions of the Government of the RF dated 22.12.2005 # 801,
I. General Provisions 1. Federal Forestry Agency is a federal body of executive power performing its functions on implementing state policy; delivering state services and managing state property in the field of forest relations. 2. Federal Forestry Agency is under the authority of the Ministry for Natural Resources of the 3. Federal Forestry Agency is guided in its activities by the Constitution of the Russian Federation; federal constitutional laws; federal laws; acts of the President of the Russian Federation and the Government of the Russian Federation; international agreements of the Russian Federation; legal-regulatory acts of the Ministry for Natural Resources of the Russian Federation as well as given Regulations. 4. Federal Forestry Agency conducts its activities directly; through its territorial organs or organizations under its authority in cooperation with other federal bodies of executive power; organs of executive power of the subjects of the Russian Federation; organs of local self-government; public associations and other institutions. II. Authorities 5. Federal Forestry Agency within the frames of its activities fulfills the following authorities: 5.2. carries out: 5.2.4. establishment of cutting ages; 5.2.7. consideration in established order of materials on transfer of lands from 5.2.19. control on expending funds allocated to regional bodies of state power for performing their authorities in the field of forest relations, in account of subventions from federal budget within the frames of its competence; 5.2.20. classification of forests as valuable forests and outlining specially protected plots and their boundaries; classification of forests as merchantable, reserve forests and outlining their boundaries; 5.3. conducts in established order contests and concludes state contracts on placing orders for supplying goods, executing works, delivering services, carrying out scientific-research, research and development and technological works for state needs; 5.4. fulfills in order and within the limits determined by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation authorities of owner with regard to federal property needed for securing fulfillment of functions of federal bodies of state power, including property transferred to federal state unitary enterprises, federal state enterprises and and other enterprises under the jurisdiction of the Agency; 5.7. organizes: 5.7.10. securing within its competence protection of data constituting state secret; 5.7.11. reception of citizens, timely and full consideration of verbal and written claims from citizens, adoption of corresponding decisions and preparation of answers to the applicants in terms determined by legislation of the Russian Federation; 5.7.12. cooperation in established order with organs of state power of the foreign countries and international organizations in corresponding field of activities; 5.8. carries out the functions of main manager and recipient of funds from federal budget allocated for administrative support of the Agency and realization of its functions; 5.9. performs the functions of state contractor in intergovernmental and federal specific programs in the Agency’s field of activities; 5.10. conducts economic analyses of activities of subordinate state unitary enterprises and approves economic indicators of their activities, carries out in subordinate organizations audit of financial and commercial activities and use of property complex; 5.11. secures mobilization readiness of the Agency, as well as control and coordination of subordinate organizations regarding their mobilization readiness; 5.12. organizes vocational training for employees of Agency’s central office, its territorial organs and organizations under its authority as well as their re-training, skills improvement and work on probation; 5.13. carries out in accordance with legislation of the 5.13.1. organizes and secures in the forests located on the lands of forest fund forest-pathological monitoring and forest seed-farming; 5.13.2. carries out the state inventory of forests; 5.13.3. determines the number of forestry units, forest parks and outlines their boundaries; 5.13.4. performs functions of state property management, delivery of state services in the field of forest relations prescribed by the Forest Code of the Russian Federation with regard to forestry units and forest parks mentioned in Part 2 Article 83 of Forest Code of the Russian Federation, and (or) in cases when abovementioned authorities are withdrawn in established order from organs of state power in the subjects of the Russian Federation; 5.13.5. determines in accordance with legislation of the Russian Federation in the field of education tasks (control figures) for determining volume and structure of students’ enrolment to educational institutions of vocational training which are under the authority of the Agency at the expense of funds from federal budget 5.14. performs other functions on state property managing, delivering state services in the field of prescribed activities if such functions are foreseen by federal laws, regulatory-legal acts of the President of the Russian Federation and the Government of the Russian Federation; 6. Federal Forestry Agency with aim of realizing its authorities in the field of determined activities has the right to: 6.1. provide legal entities and physical persons explanations regarding Agency’s activities 6.2. inquire in established order information needed for decision making on questions within the frames of Agency’s competence; 6.3. invite for developing questions connected with Agency’s activities scientific and other organizations, scientists and specialists; 6.4. create in established order deliberative collegiate organs for discussing actual issues of Agency’s activities; 6.5. create, reorganize and liquidate in established order territorial organs of the Agency; 6.6. submit materials regarding violations of forest legislation of the Russian Federation to law enforcement organs, procurator’s office and courts, lay claims in established by legislation of the Russian Federation order on recovery of damage caused to the forests; 6.9. give obligatory for execution instructions on forming forest plots from lands of Forest fund and their submission for federal needs in order established by Forest Code of the Russian Federation; 8. Federal Forestry Agency has no right to establish regulatory-legal rules in its field of activities and perform functions on control and supervision except the cases determined by decrees of the President of the Russian Federation and regulations of the Government of the Russian Federation; Established by paragraph 1 of this Article limitations of Agency’s authorities are not extended to the authorities of the Head of the Agency as for personnel and administrative issues connected with organization of Agency’s activities, monitoring of activities in headed by him Agency and its structural units. III. Organization of Activities 9. Federal Forestry Agency is led by its Head appointed to the office and dismissed from it by the Government of the Head of the Federal Forestry Agency is personally responsible for proper fulfillment of functions placed on the Agency. Head of Federal Forestry Agency has his Deputies appointed to the office and dismissed from it by the Minister for Natural Resources on recommendation of the Head of the Agency. Number of Deputy Heads of Federal Forestry Agency is determined by the Government of the 10. Head of the Federal Forestry Agency: 10.1. shares responsibilities between his Deputies; 10.2. submits to the Minister for Natural resources: 10.2.1. draft regulations on the Agency; 10.2.2. proposals regarding maximum numbers and salary fund for personnel of Agency’s central office; 10.2.3. proposals regarding appointing and dismissing Deputy Heads of the Agency as well as Heads of Agency’s territorial organs; 10.2.4. annual plan and indicators of Agency’s activities as well as report of its activities; 10.2.5. draft regulations on territorial organs of the Agency; 10.2.6. candidatures of specially merited employees for nomination them in established order to honorable titles and state awards; 10.3. approves regulations on structural units of the Agency; appoints and dismisses in established order 10.4. appoints and dismisses in established order employees of Agency’s central office and deputy heads of its territorial organs; 10.5. on the basis of Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation, the Government of the Russian Federation and Ministry for Natural Resources and in the name of their fulfillment within the frames of his competence issues orders on questions regarding Agency’s activities as well as inner organizational structure of the Agency; 10.6. solves in accordance with legislation of the 10.7. approves structure and staff of Agency’s central office within the limits of determined by the Government of the Russian Federation salary fund and strength of personnel, budget of the Agency for corresponding period foreseen by federal budget; 10.8. approves the structure of Agency’s territorial organs, staff and salary fund within the limits determined by the Government of the 10.9. appoints and dismisses in established order heads of subordinate institutions and other organizations; concludes, changes, cancels labor agreements with abovementioned managers; 10.10. approves in established order departmental awards. Their status and description; decorates employees with departmental honorable badges; 11. Financing of expenses for running costs of Federal Forestry Agency is implemented from the funds allocated by federal budget; 12. Federal Forestry Agency is a legal entity, it has its seal with picture of State Emblem of the Russian Federation and its name and other needed seals, stamps and forms of approved pattern; bank accounts opened in accordance with legislation of the Russian Federation. 13.
